Sony's most recent update to their terms and conditions makes it clear that the company can actively monitor and record your PSN activity and communications between players.
In the new Software Usage Terms, there is a section that reads 'Are we monitoring PSN?', where the company reveals that it is indeed able to monitor.

I'm glad I don't use the PS3 to communicate...sure, verizon does the same thing, but at least they don't say that I expressly consent to it after burying it in a 29 page document meant to be read only by lawyers, and which must be agreed to in order to continue using what I've already paid for.
Back in the PS2 Days it was necessary for a mod or admin or whatever to physically monitor a member if any complaints about a said member, however that member would require a certain amount of complaints from different gamers before they did anything,which made it a joke which in turn forced a room full of gamers to target that particular dipstick,not to mention a topic in the sony OZ/NZ forum ,Yeah man that brings back memories talk about flame wars,ahhhhh good times,good times hahahaha

i'm still hoping that day will come.
i actually did read the T&S on my ps3, usually i dont but i wanted to make sure nothing rediculous is in there that would get me banned,all looks very straight forward.
