if i am playing a backup and buy a map pack or online pass will it be easier to get banded from live i am flashed with the latest dash ????

You risk getting banned if MS can either detect that the game is a backup, or if they can detect that the console is flashed. Buying DLC and online passes has no effect on that.

Probably from having firmware that's not up to date and from bad burns.

Up-to-date firmware and good burns should be all you need. 3 consoles in my house all flashed in January 08 are still online (2 of them every single day).
