For some reason my battery only stays 60% charged
I think I missed up the chip in it
I didnt charge the phone properly upon first use
anyone have an idea on how to fix this with out taking it to a shop besides getting a new battery as well ?

the battery could be bad to begin with. The QA/QC on those is horrible. Take it back to your provider's store and tell them you think your battery is bad and ask them to check it for you. The battery for the last Nokia phone I had was replaced twice by Cingular for free. I've not experienced any problems with this motorola phone. Or you can try gently cleaning the battery contacts on the phone and battery yourself to see if that helps.
