If you have the option of either downloading a 320kbps song or a 128kbps but you are planning on encoding them to 192kbps either way would they sound the same or can u not improve quality encoding upwards say from 128 to 192?

You shouldn't upgrade or downgrade the quality of an MP3 file. Sound quality will get worse. If you had a choice of downloading either a 320kbps file or a 192kbps file then go with 320. But that doesnt mean it will be the best quality.

The best quality you can for an MP3 file is VBR (Variable Bit Rate) which means the bit rate fluctuates at each frame of audio compared to CBR (Constant Bit Rate) which means each frame of audio is the same e.g. 320, 192, 128. Hope this helps.
