Problem converting DIV3 files with TMPGEnc

I am currently trying to convert my movie collection that I have downloaded so that I can burn them as DVD films. I have managed to convert a few with no problems, however I seem to have a problem converting DIV3 files. If I try to convert it using TMPGEnc it wants to encode the file a 3Mbs in order to fit it onto a DVD(the quality at this setting is very poor). If I try the same thing with a DIVX4 film of about the same length it will let me encode at about 5~6Mbs. Any idea why this is and how to get around it? The film in question at the moment is Clockwork Orange.
