I am curious, Nintendo has never really had to worry about mainstream users being able to get into their systems like this. The DS used massive encryption, the possibility of bricking your system, and a (semi)unique card format to keep people from breaking into it.
When you're dealing with a system that can download games, firmware updates, etc, and runs on external power(AKA a power plug); as a company it is realized that their are things like bad wireless signal, power outages, etc, that can cause data to transmit incorrectly. So, you can't make the protection that strong, or you will see a LOT of dead units for no reason that could've been prevented.
So, naturally, the system will have to have some software protection, but not to a system-bricking point. I don't recal Nintendo ever really having to deal with this on a system so strongly designed for online play, downloads, etc. This is all new territory for them. Some may recall how hard it is for Sony to fight back PSP cracks, etc; so it begs to be asked 'How well will Nintendo be able to fight this problem?'. And there's really no answer until the system is publicly available. I'm hoping they fight it long enough to make a successful system; Because I am LOVING what they've done with the DS in the last year. I think that, whether you like Nintendo or not, their new style of gaming and play ideas would be a HUGE positive step for the industry and consumers. Gaming needs something new, not just prettier graphics. And I think Nintendo just might have it.
