Can Nintendo detect modded wii?

can they upgrade firmware?
and maybe detect the modded wiis and ban them from online play

They can't tell right now, but that's not to say it may not change in the future. I'm waiting for the first few online titles to hit this Summer, before even considering this option. That's a big concern for a lot of gamers.

Doesn't the wii key operate under stealth mode?

From the website:

# Supports fullsize 4GB discs for gamecube homebrew
# Stealth mode

If this is the case, then Nintendo cannot detect modded wii's. I can't see any other reason why the makers of the wii key would incorporate this feature in their product for any other reason besides what this thread is about.

The point is even though the chips may run in a "stealth" mode, this may not always be the case. The WiiKey is upgradeable via DVD so it will most likely stay undetected. A Wii firmware update could easily knock out any chips stealth features.
