I just got this letter today. Can anything happen to me? What should I do?

Subject: Notice Of Copyright Complaint -

We are writing to inform you that TELUS has received a complaint that alleges that your TELUS Internet Service account has been involved in copyright infringement. This complaint was traced back to your account based on the IP address used at the time of this activity.

Please note that TELUS has not provided any of your personal account information to the complainant. It is TELUS' policy to disclose such information to a complainant only if ordered to do so by a court of law, which has not happened to date.

We do, however, want you to be aware that this complaint was received by us and offer you the following information that may be of help to you:

If you are unaware of this type of activity originating from your account, you may wish to inquire with others who have access to your account.

If you are using a dial-up account, change the account password to ensure that only authorized users have access to it.

You may also want to check your system for viruses, which may explain why this sort of activity is originating from your account.

If the ADSL modem is connected to a wireless router, please make sure that only your authorized computers can connect to it and access the internet. For help in securing the wireless router, please contact the router vendor.

If you are not aware of our Acceptable Use Policy, which strictly prohibits use of our Service to infringe the copyrights of others, you may review at http://www.mytelus.com/internet/nv/aup.do. Please be aware that violation of this policy could result in disconnection of your Service.

Below is an excerpt from the complaint that we received regarding your account. We include it in this notice in an effort to help you identify the activity that is in question.

if someone can prove you've been downloading torrents, you can be sued. this happens a lot. if you live in a country where downloading copyrighted material is illegal, and it sounds like you do, then you need to stop torrenting.

try buying your stuff.

I just got the same letter. I've bought hundreds of DVDs. I watch movies in the theater on a regular basis. I wanted to see a movie none of the local video stores had in stock (I drove around and checked) so I downloaded it. - Okay boohoo me.

These are the growing pains of our society. People want fast and cheap access to media. I don't want to spend ten minutes to sign up to a service which will send me spam for the rest of my life and risk my credit card number yet again. A lot of people, especially younger people, can't afford the things they download for free.

So the message is, I can be a happy criminal or a bored law biding citizen.

I mean, if you're rich, this isn't a problem now is it? You just buy something and make with the laughing at people who aren't. You might say stuff like "get a job" or "try buying your stuff".

I'm glad to see Telus cracking down but it's more of the whip than the carrot. If you want customers the carrot is the way to go. If Telus reveals customer information they can expect to lose customers in droves, so this email carries very little weight.

There's a lot of work left to do. Until then, I'll just ride the raft down the river and hold on tight.

Since Telus is a canadian ISP, I assume you live in Canada.

It is not illegal (as in it is not a crime) to download copyrighted material in Canada. However, downloading copyrighted material is subject to civil actions. (lawsuits for money)

That letter is Telus' bow to the American recording industry. According to Telus they send out about 4000 letters a month. It has proven effective as most people stop. What the follow-up would be if it happened again, I do not know.

By the way, it is illegal to upload copyrighted material in Canada.

on a related note, what have people done for all of civilization if they couldn't afford something? they did without. people don't *need* the latest this or the new and most expensive that. society just wants you to think you do. and if you must impress society, well that's just motivation to work harder. :-P

Why should I do without?

And yes I do -need- the newst and the latest. A need is defined as a want without which you feel deprived. That's a marketing perspective though and really skews the word.

On a more practical level, as a working professional, to survive in the market, I need to be at the cutting edge with current trends. I can't do that with information and software 2 years old but I'm not successful enough to afford the latest. Should I quit and throw my career away because I'm the classic starving author always five minutes away from a best seller?

I guess that's a hard sell. The starving author really only needs a typewriter - unless he wants to sell PDFs.

I guess the most practical arguement is - the free stuff is right there. Why shouldn't I take it? Everyone else is. Define illegal when most people are downloading illegally.

Shrug, I'm going to go download a cup of coffee.

a need is something necessary to continue your survival. if you can live without it, the it is not a need.

if you're not successful enough in a given field to stay on top or at least at a place that makes you happy, then you need to switch strategies. this could mean a career change, different investments, altered priorities, etc.

when you need a car to get to work, you don't just go steal a car. you lease one, rent one, or buy one. or, you use public transportation. it works the same way with everything else.

i hardly think your argument justifies downloading music and movies; no one in the world who can't afford that stuff also has their survival, economically or any other way, set on it.

why not do it because everyone else is? because if you want to live in a given nation, you follow that nation's laws. it's the same with don't kill people, don't set people's houses on fire, and don't sodomize infants. people who do those things spend time in prison for them. do the crime, do the time. if you don't like it, you either leave the country or try to get the laws changed.

when did *everyone* decide it was okay to abandon the moral highground? it's just another symptom of the constant growth and decay of socities--too bad it's global this time.

and no, i'm not in favor of current copyright law. but i do sign petitions, and i do contact my representatives to ensure they swing the way the majority of the people they are representing want. until the law is changed, i will obey it, as i have a good amount of respect for the authority of the law. without it, the world would be a much worse place.
