1) Zelda phantom hourglass

2) Disgaea

3) Puzzle quest (both games are good but I liked challenge of the warlords better)

4) Ninjatown (insanely cute but still an awesome game)

5) New super mario bros (cant beat classic gameplay)

Honorable mention:
Mario vs Donkey Kong 2: March of the Mini's (I'm a sucker for puzzle games)

Contra 4

Top 5 lists are kinda pointless because it all depends on individual tastes. The best thing to do is to read reviews so that you can make an informed decision (sucks that there are no downloadable demos for DS like other platforms). The scores aren't enough. Especially for niche games. Since reviewers might give a game a poor grade but yet criticize aspects of a game that you may like. For eg. Phoenix Wright games would often get in the 70s and lower because some reviewers just don't "get" the visual novel (they are like text adventures with graphics) genre. Or they are of the opinion that games suck if they are too old-school and don't evolve with the times. Not that the series doesn't have problems but it's one of those games that only appeal to a certain niche (and DS has a lot of those niche games despite the myth that DS is only for kids).

If you are going to go by the reviewers though, the top 5 would be this.

GTA: China Town Wars
Chrono Trigger
Mario Kart DS
The Legend of Zelda: Phantom of the Hourglass
Advance Wars: Dual Strike (you might want to get the newer one Days of Ruin though but I haven't touched Advance Wars on the DS yet, only GBA.)

Those are the "AAA" 90+ titles for the DS and the first four are still available in stores. For Advance Wars, I think Dual Strike is out of print so it'll be harder to find.
