Yes sort of, but my friend had his 360 flashed 2 weeks ago and hadn't played any backups so they must be able to detect the firmware aswell.

So did I, so now I don't want to connect mine to live incase they take away copying games to the Hard drive.

Been banned too on ixtreme 1.6 however what i would like to know is what actually gets banned? i.e. is it the hard drive, gamertag or console?
Can anyone help with this subject?
I used to spend quite alot of money on live so Microsoft have done me a favour really LOL

If true, MS definitely does have some new mechanisms for detection of modified firmware. I am not ready to say they can necessarily detect firmware itself yet, but the game has been escalated, for sure.
$38 on new discs -- Check
$15 on burn after burn that showed as a DVD -- Check
$11 on new laser -- Check
$28 on new multimeter -- Check

Or it might be possible whoever flahsed it swapped it with an older console that they knew had played bad copies and was in for a ban.

My theory is they are banning at certain times of the day. Maybe at the peak hours of xbox live which is probably around 6pm eastern time. Or could be by location. After warning my friends, one of them logged in and played on xbox live around 10pm eastern time. I know he plays bad burned games (He has tekken 6,GTA,and call of duty MW2 as Wave 3 and Halo odst FRENCH version) I dont know if he went online with them but he does play offline with them with his hard drive attached. He played last night on live and was NOT banned. Also I know of 2 systems that were banned around 6pm in 2 different locations both use abgx to verify games and dont play early.

New Info A good rip of Left 4 Dead was tested on it while offline but nothing else has been played.

Well there you have it. It had booted at least 1 backup before it was banned. So there's nothing to be learned from this particular case.

yo this is *bleep*. so im not banned yet. im running a hitach wid 1.51 firmware and not banned. So i read this thing on xboxscene.com and a guy said he got banned and he turned it on after a few mins and he was unbanned. So i told my frend to do that cause he got banned, and now hes not banned now :S. this is confusing. I dont know his info but yea dis soo wierd.

This is really weird.
I logged into Xbox live and it said I was banned. A little bit later I logged back in and it said I connected to live. Anyone ever have this happen before?

So I read on the xbox scene forums that a guy got banned and he signed in a little bit later and was unbanned. So I told my friend to try that because he was banned and it worked. he got UNBANNED! I dont know his info though. Im running a hitachi 1.51 FW and never played a game early, and im not banned as of now. I have a friend who played the leaked version of mw2 online on monday. Like he played a TDM match and he plays lots of games early. I also dont know his drive either. And he is still NOT BANNED. This is really wierd, seems like a bug.

Strange. This just happened to me too. I have a liteon 7xxx with ixtreme 1.6. Have played many backups, but all have been stealth and verified with abgx, and have never played anything early. Flashed drive with ck3, and so the drive has never been powered through the 360 while sata was disconnected.
Was playing Forza 3 a little while ago, and I was signed out of xbox live. I went to sign back in, and got a message that my console was banned for TOS violation. Stopped playing, and 15 minutes later tried to sign back in, and it worked.
