Well, I don't see how it would be possible to read the firmware on the dvd drive. But if the ban wave continues they might have found a way.

OK, so at the very least, it's plausible that MS can detect whether you have hacked firmware or not (relating to the recent dashboard update?). If there are some people taking all the necessary precautions and STILL getting banned, then there has to be some new trick MS has come up with that we haven't realized.
Obviously some haven't been banned yet, and these people more or less act the same as those who have gotten banned. The question now is how are some people getting banned and others aren't.
Based on the accounts of those who've been banned from this thread, a wide range of people are getting hit by the hammer, (both people who are careful and people who really aren't). This suggests to me that MS is doing some sort of random checking test to determine whether you have a modded console, but who really knows anyway...

I had reported back a couple pages that I was banned earlier today, then "unbanned" about 15 minutes later. Like larry though, it didn't last long. Just tried again a few hours later, and I am once again banned.

I just read the first page of comments back when this thread started and man does the OP get ripped a new one,not so smug now are you(all the belittler's lol).
Anyway back on thread,my suggestion would be to stay off live for at least the forseable future,or until we hear from the people in the know, as it's becoming apparent that only a few are surviving this ban so i'm guessing,and its merely a guess on my part,is that m$ can now pick up firmware from the drives as i find it impossible to believe that every firmware,every drive and all senerio's of what games where played and when can come to some pattern for this clear carpet ban!!
We're all in trouble.....

You might as well wait another week or two until the ban wave is over... then you will at least be assured of unbanned play until the next ban wave comes along.

But, to answer your question, yes, you should use 1.61, as it is the latest and greatest.
$38 on new discs -- Check

I just got banned. Turned my Xbox off at like 12:30, got back on and boom, console ban.

well talking with some friends we concluded that obviously theres a method to know if your firmware is hacked or the game you are playing is a copy.
got me thinking now, and may sound crazy, has anybody been banned playing an ORIGINAL game on a modded xbox ???

I rip all my own games. Run ABGX on the ISO file , which, I was told isnt really neccasary. Then I burn and play fine without re-checking disc with ABGX. I am still good with no BAN. I have Lite-On drive, not sure what model #, it is the 2nd one that was released. I have Ix 1.6 on it.

Man thats great! Im glad your taking the right precautions as am i! So far im not banned, and i had a previous console banned also back in Nov but i was playing everything early GOW etc etc not verifying, just a pure sh** storm... I just wasn't taking the right precautions back then. Im gonna post in here once i do get banned with all my info seeing that ALOT of people are getting the hammer and are taking the right precautions im assuming my turn is soon.

Yes, there was someone on here that said he got banned when he was just downloading a theme package. Everyone who has a modded system has, no doubt, played a ripped game. People have been banned who haven't even played ripped games in a while. M$ has some way of telling the xbox is modded regardless of the use of the system (I have no idea how!!). Kind of freaky.
Here's what I've suggested to all my friends. M$ can read your system while it's connected to the internet...even if it's not turned on. So I've told them to, not only stay off live, but to unplug the ethernet completely. Since everyone wasn't banned at the same time, it makes since that M$ is doing it manually. If you can stay off line until that runs its course then you might have a shot at avoiding the hammer. I connected earlier today to test it and I was fine. I was only on for a minute or so. But this proves that the bans are not being done automatically. If you get online and stay online long enough for them to get to you, you will most likely get banned. Give it some time and we'll see what people come up with.

Got a call today from my buddy who got my box modded for me. He was telling me to unplug my ethernet right away because one of our other friends got banned when he was playing H3 odst multiplayer. I was playing on live 2 hours after he had got banned before I found out. Once I recieved news I started looking here to find answers/cures for this issue when I stumbled upon this...first few posts were maybe a little helpful...then it got to the 15 pages of 16 year old boys fighting like 8th grade girls...finally read a post where the person didnt have 75 quotes just to belittle someone else and the guy was asking if the ban wave is over...no, apparently it is not. Just got word that my cousin's box got the ban...all of ours were modded by the same person, relatively close to the same time. I am not quite sure what version of FW we each individually have nor the drive. I do know that the other two mainly get their games for themselves..and I get mine from the dude that originally modded my xbox for me just because he has some credibility to him. Think im going to wait to hook my ethernet back up to my xbox till tomorrow. That way I have a whole day to sulk in sadness...I dont know what id do without my box...where else am i supposed to get false sense of achievement if nothing is popping up at the top of my view...stroking my ego w 50 gamerscore?!?!?!?!?

Unhooking the plug doesnt help, M$ knows who theyre gonna ban and they've known for a long time now but if it makes you feel safer go right ahead. ;)
ps. one of my boys does the same thing, its a compulsion he has but its really just avoiding the inevitable.

I was kind of thinking that myself, at first. But, if this had been laid out for a while then everyone would have been banned within a matter of hours of each other. This has now gone on for over a week. I've had a modded system for years. I should have been at the top of the list. Some have reported that they only had a modded system for a few days when they got banned. I don't think that anyone really knows how this is happening but I think it would be logical to assume that getting on live right now with a modded system will severely increase the chances of you getting banned. Unplugging your ethernet and praying are the only things you can really do at this point....most of us are probably already dead in the water but it wouldn't hurt to avoid some possible risks.

I Modded a friends 360 a few month back with ix1.6, he called me last night to say he had been banned and asked if i had been. at which point i hadn't. I was quite surprised as he plays original games, and the only backup he owns is Batman, which has been fully verified etc. Anyways he called me back about half hour later to tell me that he was able to reconnect...!! i then was playing about an hour later and got the dreaded this console has been banned message. That was about 10pm (GMT) last night, it is now 10hrs later and mine is still banned, so i think mine is a definite. I just find it really bizzare how his has been lifted?
Has anyone else had this experience?

I'm not overly fussed about it, as i only really use live to play with a couple of my friends that live locally. Quite often get all 4 xboxs in the same room, and use the same router to connect through live, so we can quite as easily use system link. I'll let you know if my ban gets lifted, but i highly doubt it! as i am sure that there is one or two of my games that are not verified correctly (i used to get them through a friend) so cannot be 100% on them.

Well if they are doing this manually then staying off live would be smart at least till this wave is over. I mean there's a ban wave and all we keep doing is logging in to check if we've been banned???
Maybe going back to the original fw would be a good idea also. It's very unlikely to last beyond this month although no one really knows for sure.
