Mod chip and HD Advance

Ok, newbie here (go easy on me)
I just got a PS2, put and set it up to run HD Advance. Things are running great, but my question is, if I buy a mod chip, do I still have to boot my PS2 with the HD Advance cd?
In other words, will the mod chip boot the PS2? I am looking at buying the Duo2 se for several reasons. Any opinion?
Also, since I live in the US, is it illegal to buy Mod chips? I keep hearing conflicting stories. When you ask a PS2 game dealer, they look at you like you just asked if they sell drugs!
