If I purchased a http://www.modchipstore.com/PS2_No_Solder_V4_Mod_and_Swap_Magic_v30_30_Combo-p-16147.html, does that mean i need to have a flop top in order to use my Magic Swap 3 version 3.3?

No you don't need a flip top, the mod chip will allow you to swap discs by just ejecting the tray.
