how illegal is it to backup dvds in US? exactly how do people get caught and fined/charged with this stuff anyway? i think it's ridiculous that it's actually illegal for people to backup their own dvds, that they purchased themselves.

From CNet Reviews April, 2004
Quote:
The ability to create copies of the media you've purchased for personal use is a long-accepted facet of the fair-use doctrine in U.S. copyright law (at least, it used to be). However, the Digital Millennium Copyright Act (DMCA) states that it's illegal to break the CSS copy-protection mechanism employed by most commercial DVD movies. What does that mean? Most fair-use advocates say that the policy directly contradicts U.S. copyright law, but the DMCA seems to indicate that you cannot make a copy of a commercial DVD, even for personal use, and you certainly cannot give a copied DVD to anyone or watch copied DVD files on your computer. We assume that fair use will eventually catch up and be established as a safety valve for consumers (which has been the pattern with previous technologies, such as VHS), but for now, the territory is still uncertain and a bit dangerous

so how exactly would one go about getting caught doing this, if it is a bit dangerous? it just seems like there is no way people can find out you backup dvds, especially if you keep them only for your own use. the only people to know would be those movie rental store workers who see you come in 10 times a day, but i'd doubt they can get you into any real trouble.

i have a hard time doing things that i know could come back to me someday, that i know someone COULD just bang my door down and arrest me for because i did something like a copy a dvd 2 years ago. it's different than smoking pot, or something along those lines, because once you've done it, you can't get in trouble for it. but once you backup a dvd, you have the rest of that dvd's life that you could get in trouble for it. i just don't like that idea. anyone else have any further comments regarding this issue? i'd like to hear other opinions.

You'd have to get caught selling them or give them to an undercover agent or something.... It's not like someone is going to break into your house and look at your backups and say.. HEY do you have the Originals?

But surprisingly especially where I live (SC) that people out here don't get caught because I see people at the local flea market selling movies on DVD that just came out at the theatres never mind are out on video or DVD Yet.....

If you're in your own home and don't announce that you make backups to the world you're fine...
