I repeat ... ANYDVD .. I realized that you were talking about a data CD before I recommended ANYDVD
I have the program and I've duplicated protected data CDs using it!!

Use A Ray Scanner and scan the software cd (or directory if already installed) to determine what cd protection you are trying to back up. CloneCD, Alcohol 120% are good programs to backup cd protection.
In some cases your burner must be able to write RAO DAO mode and read sub channel data(96/16).

Tried the latest version of A Ray Scanner and it says no protection detected. Any other ideas?

If you can't lauch the software via Daemon Tools 4.0(or Alcohol 120% virtual stealth drive) then chances are you can't make a true 1:1 backup. Try scanning the software disc and the directory again with the latest A Ray Scanner.
