It's both, meaning it's FREE if you recently purchased a dvd burner, then you're likely to have Nero for free. It's not free and you may have to buy it at retail store or at the official Nero site online.
I got my Nero for free when I purchased my burner.

What some burners' give for free, is an OEM program, a cut-down version of the full program. ..see below..

(pronounced as separate letters) Short for original equipment manufacturer, which is a misleading term for a company that has a special relationship with computer producers. OEMs buy computers in bulk and customize them for a particular application. They then sell the customized computer under their own name. The term is really a misnomer because OEMs are not the original manufacturers -- they are the customizers.

The OEM version of Nero will run, with DVD Shrink, and the basics, but lacks most of the refinements of the full version.

I've got Nero 6.0.0.21b OEM on all 3 of my pcs. It burns cds and dvds very well. I just don't have the use of Nero speed test to scan for errors. I got those oem discs with a couple of my drives. I even gave away a couple of them away.
You can get nero6 version 3 at ebay for around $5
HP a1118x-b/athlon 64-3300+/BenQ 1650 BCDC/LG 8163B/Modded Wii/Epson-R300 and Ty Watershields!!!

@ saugmon I've got the Nero latest 6.6 version. I got speed test, but neither of my drives (TDK nor LG) support the grading test on the burnt dvd.

I got Nero Express with my LG burner. I have since switched burners and now I have a pioneer. I would like to try burning a double layer disc. I was able to change my settings in the shrink from DVD5 to DVD9 Still it's not working. I suspect my current version of Nero doesn't do what I need it to .Any advice? Thanks

You don't really need Nero to successfully burn to dual layer media, try using a free application called Imgburn.
Have DVDshrink create an ISO image output file when backing up and specify a location, then use Imgburn to burn the file to disk. It's very simple to use and gets the job done.

Try DVD Decrypter in ISO mode. Mode ISO read to hard drive and Mode ISO write/locate mds files/open/and burn.DVD Decrypter is free!
nero6 does have trouble with the layer break. Dvd decrypter's iso mode is for non compressed backups with a 1:1 copy. I don't even bother with using Nero on dl backups.DVD Decrypter also has a file mode,but that's for compressed backups using DVD Shrink.You won't need that mode for a 1:1 copy.
Another option is to rip with dvd decryper in ISO mode and burn with IMGburn. Very similar to DVD Decrypter in ISO write mode. It is said to be a more effective DL burn engine. It looks the same as DVD Decrypter,even authored by the same lightningUK him/herself?

I don't know about you guys, but for my Nero 6 Ultra that came with the burner with a Nero CD software package, including a key serial number. So when I installed my Nero 6 Ultra on my system, I just went to Nero site and download Nero 6 Ultra's major updates (usually package #1 & #2 only), but NOT INCD & other junks and it automatically detected the key and accepted it. I guess I was lucky because I'm able to get basically everything from Nero Express, Nero Burning Rom, Nero Vision, Nero Recode 2, Nero ShowTime, Nero CD-DVD Speed, etc. for some unknown reason. Well that's how I got Nero 6 Ultra for free.
If I remembered it correctly, my last Nero 6 Ultra is 6.6.0.18 or something. As of mid October 2005, I've switched to Nero 7 and it has been burning flawlessly for me. Nero 6 and Nero 7 has been good, until I recently updated to the latest of Nero 7.0.5.4 (which has tons of bugs for me), so I went back to Nero 7.0.1.4 and everythings is burning as flawless as before.

I did notice that the lates version of Nero (7.0.5.4) was acting a little funny and slower when using some it's apps. Maybe going back to version 7.0.1.4 might not be such a bad idea.

Yes, the latest Nero 7.0.5.4 has more than just a few bugs. I can confirmed it, I'm usually the one to compliment Nero 7, but NOT this time. Nero 7 has been good with me until their latest version 7.0.5.4, for whatever reason Nero Recode, Nero Digital, Nero Vision and Nero ShowTime doesn't worked for me at all. So I end up going back to 7.0.1.4 and boom... everythings running as smoothly as it has been. I can wait another month or 2 until Ahead or Nero has fixed all of the bugs in 7.0.5.4 before I'm going to update again.

I purchased 7 when it came out and it had bugs I went back to 6 and am waiting til it clears up before I go back to 7. That is what is so great about AD, eventually you find out what is working and what is not. At least I know the latest is still not the greatest.
