Doesn't matter.I've been selling stuff on ebay for 3 yrs and I know they will just shut your auction down.So it will never make it to the end.You could try a 1 day auction but ebay has 1000's of paid folks that go around looking just for keywords that indicate something prohibited.Think of mods here times a bizillion.

<edit>.As far as homebrew you had better make sure you own the copyright or they can sue you.Period.

@Thirst - Your right, havent any of you guys seen those disclaimers on a lot of the homebrew released lately. it alwasy reads something like "this is freeware, and if you paid for it, you got scammed" or something like that.
Im not sure why the hell this keep going back to freeware, the point was BABA or whoever thought its cute to sell pirated games, which is not. Only thing thats cute (not really) about it is how whoever does it is going to be real goods friends with some dude named Bubba in the state pen.
Spybot is freeware can you sell it?
If the homebrew is a knockoff(mario) the copyright is still the original publishers.And if it's original content the copyright resides with the owner.There is usually a license agreement stating you can't sell it and other regulations if the content is original.
Furthermore it really doesn't matter because ebay won't allow it.I know alot of homebrew copyright is sketchy and even illegal in some cases but you had better know before you sell someones creation.

Yea, but you're not selling the knockoffs, you're releasing them to the public for free. Therefore it's not that big of a deal.
Secondly, alot of homebrew authors say "I would prefer it if you include the program in a sale for free/as a bonus instead of rather actually selling it." The homebrew authors aren't really concerned if someone is selling their program because they released it for free in the first place.
@Ty, I beleive you can sell it, but the person wh buys it is an idiot of they do. Is still frowned upon, you have to be a lowlife to sell something that is of no cost.
I say let them sell it, I need a good laugh when I see their ugly mugs on the evening news for copyright infringement:D
Guess I'll weigh in by saying that anyone who tries to sell something that folks can get for free should be castrated and have his skull cracked open.
I've seen plenty of low life pieces of crap come here pimping their pay-for software that consisted of nothing more than DVD Decypter or DVD Shrink (both freeware) with some silly instructions, also free at sites like ours.
Both authors of Decrypter and Shrink could've made a bundle off their their apps but they were a rare breed that shared their labors with the world for nothing and it takes a special breed spineless scumsucker to try and profit off their hard work like that.
To anyone here that thinks it's ok to try and sell freeware apps - go jump off a cliff.
