I have never tried it myself, But if your using your OWN backup and not one that you have downloaded from a torrent or newsgroup I cant see how they would know it was a back up, and why should you not be able to play online with your own backup.

Exactly thorn3562, but you never know. There's been about 5 million Xbox 360s sold so far. I'm pretty sure less than 1% of those have haked firmware on them. A check system would require a large investment of resourses. Didn't that video of the PRG3 drop in March? Hell, it's October now and back ups are still being played on Live.

Althouh,on the contrary,MS have said that they are looking into the matter.likely that it's covered up until early next year and then bam ms comes at you with the vengence(just before halo3 is released),and it actually would not cost that much to stop firmware hackers, just a simple online update that detecs version of drive, when it detecs one it doesnt know,it automaticly downloads a file onto you 360,and next time you try to log onto live, kabam "Sorry, you have been banned from xbox live, please contact MS"

Or ms could just be bullshitting consumers, but who knows for sure?

I will be buying an xbox 360 shortly myself. Having the LIVE feature is very important for me so I can play my mates all over the country at pro evo next month. I'm also worried about getting mine modded as I would hate to be banned.

I wonder whether they can get a fix? I personally cannot see it being expensive either - after all it would not be hard for a check to take place or something.

I wouldn't have thought they would do anything to your xbox. It is a little unfair how you can't play backups online, at the end of the day your just playing with a copy of your own game. I guess M$ though see this as all backup games are 9 out of 10 times copies and not backups!

I'm not to sure about this, but i think someone should look into the law a little, see i'm not sure if your 100% allowed to play a backup game online(but i think you should be able to) another thing, the law does state that you are allowed to make one backup copy for yourself...so maybe,if ms does start banning people on live for changing firmware, maybe you can sue them, although unlikley since you actuallly modified the 360,which is against the law,and since ms is a multi billion $ corparation,i think you'd loose a court case anyway...but yeah, well just have to wait and see what happens...

To sam302005:other than banning u on live, there nothing else they can do...

Yeah thats true, don't try and sue ms cuz they have waaaaay to much money! They'll pay off the jury and judge.

Can you pre-order the PS3 all ready?

The in the US the DMCA (Digital Millennium Copyright Act) makes it illegal to circumvent any copyright protection. That's what you do by flashing and making a backup. If anything MS could sue you. They wouldn't, but they could. It may be different in different countries.
