i think you will get banned, but do what you like. im not sure wether they can detect it yet or not.
and what do you mean by modding?
all you can do on a 360 just now is play backups.

as of now there has been nobody banned the new FW are stealth so there is now way they cant tell if you have flashed I cant remember if there are any stealth software ripps yet but still nobody has gotten banned YET

No one has been banned yet. No one knows for sure if it will ever happen. One thing I do know is people are kidding themselves if they think they are safe from a possible ban using the current stealth firmwares.
