i know at the moment ppl arnt getting banned for playing backup games on live. However im upgrading my firmware soon. My question is say they updated it to check ppl playing copies on live. If i played my backups without connecting to live and played my originals on live could they still ban me?

they can't "BAN" you if you dont use live, per se.

If you mod your firmware and NEVER go live, the only way they could mod the FW back would be via an update tru a game, and as far as i know it can't be detected with the new firmware.
