Can you play on Xbox live if you have a dvd firmwire mod. Can play backups online. If so do you have to do something extra (like how on ps2 you have to patch the backup before you play it online)

Yes you can play backups online. Regarding the patch, well, most releases(and thats almost all releases) are pre-patched so i wouldnt worry abt it.

But I heard that you have to install an update to play them online but once you install it you are banned

All updates worked fine for me. Nothing happened. I can play Gears online just fine.

Its that MS has not started banning anyone yet. So for now you are safe. Those who got their system bricked was a fault in the patch itself.
