My 2 Cents:
Sammy Drive
4.2 firmware
Only use back ups
Console flashed for at least 8 months before connecting to XBL
Based in the UK
Not banned yet but only signed up for XBL 9 days ago. Boy will I be p*ssed when the ban hits me. Hardly got value for money from my subscription have I if I get banned? However as stated by others, it's my own fault, I knew the risk I was taking. Just bad timing on my part :-(
Considered my options:
1. Take it on the chin and no longer able to play on live
2. Go out and buy another 360.
I think for now I'll be sticking with the first option. Initially I couldn't believe how great live is/was. I think the novelty has worn a little now. I've entered one too many games of GRAW2 only to discover I'm being deliberately targetted by my own team mates. The same thing happened with Rainbow 6 Vegas. Where's the fun in killing your own team mates, I don't get it?
Is live really all that great? Have I been unlucky with my experience so far?
I'm going off topic, sorry people. I think I can live without "live"

With my console, I played an original, flashed it, then went on xbox live. I am still unbanned. Has there anyone been banned who has modded first then gone on live like I did?
mr lip ur right i think thats it people like myself went online with orig then modded and went back on ms picked it up then banned us any1 else n the boat with me

Can you get banned by using backups on a NME v1.3?
What about by playing originals on a NME v1.3?

I was wondering if it had something to do with crackdown because my friend talk to a microsoft rep and he said that it was something embedded in the spring update and was able to tell if the crackdown disc was fake is that true or is MS giving the runaround.

Same here I took mine out of the box and had it modded before it ever went online.

I thought if you cleared the cache it would make you upgrade again. Don't kill me if I'm wrong.. I did the xxLBRBxx thing and I had to update everytime I put a different game in.

PM sent. I'm gonna try to flash a brand new Sammy, before I even turn it on and see if that gets banned too.
