If I have the latest firmware on my xbox 360, and use back-up copies on my 360, but do not use these online, and only use the original games online will I still get banned?

and if i have a globe360 modechip and i format the disk and create a new gamertag
and go online without the chip working(origenal frimware untached)
and with origenal game then i will get ban to ??

if you mod the console in any way there is a very good chance that you will get banned.
