Just been reading some other threads and people talking about getting banned from live, what exactly happens, i know they stop you from goin on live, so couldnt you just buy a new hard drive and start again?

the ban is not in the hdd or the live account, its in the 360 its self.

correct, they ban the actual console ID which is unique to your console. That way your account is still open and if you want to use it then you have to buy a new console.
