The first thing you need to do is obtain your original key from your present drive. So you will have to read the tut on how to flash your 360 dvd drive with xtreme, and follow the first few steps to obtain the original firmware, once you have done that, you flash the new drive with the original firmware, you can then install the new drive in your xbox.

My question is if I use this to replace my drive, will I be able to play on xbox live or will my account be banned?

if you take 1 xbox 360 drive and put it into another xbox 360...the drive keys will not match, and it will be bricked.

also I'm not interested in playing backups, i just want my drive working and the 360 is out of warranty.

If you flash the replacement drive with the standard ot modified firmware, but never use backups, your xbox will not get banned on live.
