I'm wondering if I get banned from live, can I still be able to go to the marketplace?

Will I get banned if I don't play online but I download stuff from the marletplace

but how can they ban me for having a modded 360 by downloading demos off the marketplace if I'm not using my DVD drive.

The only way to be sure of not getting banned is to unplug your cable from the 360 before you even load a backup in to the drive. It doesn't matter if you're not signed on to your LIVE gamertag. Even if you're not signed in, if you start your 360 with a backup in and the cable plugged in, info gets transmitted back to MS.
