all is sorted.
after reading the post about COD 4 and re-reading this one, i checked the disk for scratches and fingerprints, and found some, so i gave the disk a clean, popped it back it the sammy dvd-rom and tried the backup again. This time without any problems, i then burned it and checked it in my 360 and it worked fine.
so thanks to all suggestions/ advice in these 2 posts, especially fudpucker.
It just goes to show that the simplest of things can cause the biggest of problems if you dont read things through properly.
Again MANY THANKS all

if fudpucker actually listens, he'll learn as i said before, that the disc is Brand New!!and therefore there are no smudge marks or scratches. Man!! and you called me an asshole. ur the one who once again made the same stupid comment.
