When you first get a brand new 360, you get a silver membership Xbox Live, is it a code that's on a card? I can't find it, and if it is a code and I don't want it can I give it to a friend?

no, its free, your friend can get one if he wants for FREE. all the silver membership does is let you download demos, and other crap from the market place.

When you first get 360 you get a 1 month gold membership and it is in the 360 itself, once you plug it into the internet and setup your account it will notify you of your free month so I don't think there is a way of giving it away.

Silver is free... it's always free. There's nothing to give away. Just sign up with LIVE on your 360.

To get the free 1 month gold, sign up for free silver. It'll ask you if you're sure you want silver, or want to pay for gold. Select no and stay with silver. The next screen will tell you that you qualify for 1 month free gold. Then you select it.

you get silver when you make a new gamertag and for the first 3 xbl gamertags you make you get one month of gold free with each one. but only with the first 3.
