Okay I have an 360 hitachi 79FL so I sent it to CUSTOMGAMEWERKZ along with a passkey(maximus) to have it modded and I get the box back with the following letter-Dear Mr. XXXX I am sorry to inform you that the modification of your xbox 360 didn't go as planned. I was able to successfully install the chip however once I got the console into mode B and was preparing it flash it the drive disappeared out of windows explorer-upon further examination I found that the drive stop working all together. I did my best to try to get it to function again but to no avail. unfortunately this type of thing happens one in a while I'm truly sorry however we don't issue refunds and customers assume full responsiblity for any damages due to modification. I have sent back your chip and console one again I'm sorry.-Now to say I'm pissed is an understatement guys be careful I got burned my console does come on but the drive won't open. This was a new console that was tested by me and working fine. On top of that this scumbag won't refund my money for his blunder.

Wow, definitely sounds like a scam. How did you pay? As long as you didn't pay cash or check, you should dispute it for sure. If money order, call the money order people up and see if you have any recourse.

i would never send my console to someone else. i know its easy but you are better off to teach yourself and then do it yourself. i doubt you will get your money back. you just sent money with paypal, paypal wasnt offering you any services. the credit card company might be able to help you, but good luck explaining your situation to them. sorry to hear your bad luck man.

Bad luck about your console bud,i'm not sure if this will help but take a look at this link(http://www.creditcards.com/credit-card-news/card-member-benefits-visa-warranty-manager-1268.php).
Might be worth asking your credit card provider in any case.

bad luck, that guy shud have taken responsibility for it. I payed someone to flash my hitachi 79 few weeks bak now but i was careful who i choose. I settled on a guy i could drive to his house and meet in person, also he offered lifetime warrenty.

Yeah I don't trust sending my console off to anyone either.I would rather learn it on my own,because there are a couple reasons.They could botch it up like what just happened,and second they can swap out or use different hardware without you even knowing it.Another example is using clone chips which end up messing up systems.If you can't do the install yourself search high and low for someone reputable before jumping the gun.

if you paid via paypal, you can dispute it. and you might be SOL if he stated that the person that provides the service is not liable for damages and stuff like that, however, if he didnt state such a thing, then you shouldnt have a problem getting your money back.

Thanks Guys for all the input I'm going to try that This guy just gives modders a bad rap and I want to make sure that no one goes thru this or deals with this company. Thanks Again for all your suggestions I really do appreciate it!

I use PayPal quite abit, and they do offer protection. Dispute it with PayPal first, then if that doesn't work out, dispute it with your credit card company.
But considering what you were paying for (modding a 360), you may be out of luck. The cc company and Paypal may not consider modding to be legitimate and that means they may not offer protection for that.
But it's worth a try.

I bet these people know what they are doing in scamming people and have it all set up where the payment disputes come out in their favor. Sure you aren't the first one to have been scammed by them sadly.

to file a complaint with paypal or a credit card company in this situation would be like, calling the cops on a guy that sold you fake crack!

This is the same reason why I wouldn't send my console off to anyone... But I have had people send me their consoles and only ONCE did I have an issue. But I just went out and bought the guy a new console because it was MY fault. That's how a real man does business :)

fudpucker, it is nothing like your comparison at all. buying crack is a crime. modding an xbox is not a criminal offense, so thats not really a good simile at all.
meh, paypal will dispute it, they did not provide you the service they offered.
here is an exact exerpt from their terms and conditions
"If for some reason your console can?t be serviced, it will be shipped back to you with insurance and your money will be credited back to your PayPal account for the original amount minus return shipping, a $10.00 service charge, insurance & PayPal charges of 3%."
also, they dont have a website up anymore, google search and look at cached pages. sounds like u picked a real loser, but they wont be f'ing anyone else over buddy. im sure you can repair your drive, just find a real expert to fix it up...

Yep-they shut down shop, I did try to dispute it with Paypal but lost so I'm out $60.00 I found a company VGC repairs that will replace the drive if necessary and also install my passkey he going to give me an estimate before working on it and if the cost is high then I'll just take the loss and go buy a 299.00 box from BBuy. Just have to make sure it has a BenQ drive so I don't go thru this again. Lesson learned!

That Passkey is a real bitch to install and get working. A lot of modders with pretty good soldering skills don't want to mess with it, because it's easy to screw up. A heads up for the next time always fund with a credit when using paypal especially if you are unsure about someone. That way if the deal goes bad you can issue a chargeback with your credit card company and there's nothing Paypal and do about it if you are in the right.

Thanks Mem-actually I did pay by credit card I didn't contact them and since the guys no longer in business I aasumed I was screwed but do you think I could still file a chargeback and who would I be getting my money back from if he's no longer in business? I tried to dispute it with Paypal but to no avail.

I believe you have up to 6 months after the transaction I think with any credit card to file a chargeback. It's Paypal who'd have to give up the $60 and it's up to them to try to get the money from the guy. Paypal is obviously still in business. I'd file the chargeback. Credit card companies pretty much always side with the card holders in these situations. You'd just have to figure out how you'd want to word the situation.

Heres a thought.. have you actually opened it up and checked that the chip is fitted to the drive? If not, or you suspect the drive or parts have been exchanged deliberately for faulty ones you have a case.
Unfortunately if it says clearly that they give no guarantees for work or damage/loss during modding on the main page (the one you use to order the service) then they are allowed to operate in that manner .. "at your own risk" is an acceptable legal term.. and you have agreed to that in the first instance, so they are only playing by their completely legal rules..
You may feel ripped off, and may well have been ripped off, but if you have agreed to put yourself in a position to be ripped off then it's "at your own risk"
devils advocate, and how a disputes assessor would look at it.

If the TSOP chip on the dvd drive motherboard is desoldered and flashed with a Willem EPROM programmer you may be able to recover your system.If you can take pictures of the Hitachi 79FL motherboard so I can take a look at it you might be able to recover it.I don't currently have the equipment to do the job on me,but I'm sure I could probably find you someone that might help.

Varnul-actually I did open the case and check it out, didn't notice any visible damage and yes I read his agreement before sending my box in and the guy clearly stated that if your unit couldn't be serviced he'd refund your money minus shipping. Here's what a modder said in the forum where I fouind this guy-As for the drive itself, Drives don't just "disappear" from Windows. I think an accident happened while the drive was being prepared for flash extraction (if it ever got that far) Either power cable came loose and was plugged in the wrong way = toast or passkey got ripped off (damaged traces) Only the installer knows what exactly happened. L-Burma-I was told that a TSOP could help me so I sent my unit to VGC repairs in Cali. I checked them out and was actually able to speak with a live person he told me that once he gets my box he'll give me a quote on repairs.

That's not so bad then.. you just need to hold them to it.
I have seen one samsung drive go out while reading it. It will read and write now, but always gives a bad flash situation. Suspected static flashover from the nubs bad old monitor ;)
I was just playing devils advocate before.. my first husband was a loss assessor XD
