I have seen yes and no to this question so trying to get some more answers from users here. I ran into some legal troubles recently and had a few things confiscated. I still own a 360 and I do have backups of 6 games I own so nothing wrong there. But i am wondering if a flashed 360 itself is legal or no?

OK guys it's not like right when you flash your 360 it triggers the FBI's brains to come after you. As long as you don't hop out of your house and yell out "I HAVE FLASHED MY 360!!!" then you should be fine. OK even if you do do that you will still be fine but it will make you look like an arse.

All you have to do is keep it low and don't be an idiot and sell backups to the masses.

I do not think the actual modding of a console is illegal. It is the backing up of games that is illegal in some countries (copyright laws). So since the sole purpose of a modded system is to play back up discs then they tend to frown on that as well.

On the other hand the government did raid quite a few stores that modded consoles and put a real hurting on the community a while back. I happened to have known one of the owners of a store, and it is not like these stores were selling back up games. They were raided simply because they had a copnsole modding service. So basically the government will do whatever they like.

Yeah i don't think its a crime to have a modded Xbox or have backed-up games. Its a crime to make back-ups of a game and sell them. Thats really the only way imo that making back-ups would get you into trouble.

NO, in some countries like the USA it is illegal to make a back up copy. It is copyright infringement. And although i do not personally believe that it should be that is how it is.
