Is it still possible to get banned from back ups?

If I mod it and play back ups, will I get banned? I read a long time ago that you will get banned if you do that because of some security code on the disc that is detected when on LIVE...

there is one thing where if you get a game that isnt out yet then xbox like infect your xbox 360, but if you got it when it came out then its because you need to mod it even more to make sure that live dont figure that out its hard to do and i dont know how to do it but it works
