Legit Use of Spoofed 360 DVD Drive

I have read the rules and I hope this question complies with them.
There are many threads about the risk of being banned from XBL for having modded DVD firmware. However, I cannot find an instance of someone who has never played, nor intended to play an illegal copy of a disc. My DVD drive is broken, I want to replace cheaply, the best way to do that is by extracting the key and pactching a different drive.
If I do this, and I never put a burned/illegal/etc. game in the drive, do i run the risk of being banned?

if you want to have no risk of being banned and remain 100% legit you would need to send the xbox to microsoft for repair... if its out of warranty you'd have to pay them to do the repair ...
otherwise you are violating all of their policies by modifying the console yourself... as such you'd run the risk of being banned.

There are a ton of threads about this. Yes, you can replace the drive yourself. Just purchase the same model and version. That way you don't have to spoof the new drive as another model. Everything will be legit.
If you do purchase a different model, then it would have to be spoofed, which would require modded firmware. Using the same model and version, you only use original firmware. So that's fine.

I'll make my question more clear, because I am well aware of the answers given.
Does MS check for firmware mods, OR does it check the games?
I have read many posts about how I should send in my 360. Not an option. $100 or $20 on Amazon? I will go with Amazon.
I have also read articles that have suggested that MS only looks for markers missing on burned copies of games. I will NOT be playing pirated games, so my question is novel and has not been addressed by most, if not all, of the threads regarding banning.

I don't think anyone has the knowledge to answer your question Red.
However in the spirit of learning I encourage you to go for it and let us know. That way we'll have some sort of clue if you ever get banned and only play retail games.

Lets try this one more time... you don't have to mod the firmware.
Use the same model and version. If the drive is not reading discs anymore, just swap your old board in to the new drive.

Now, let me try this one more time. I am cheap. I am a student with a family and I have limited income.
A drive on ebay (lowest price I've found) matching my drive model and FW is over 2x as expensive as a Samsung drive on Amazon.
Stop answering the question with the same answers. I know I can swap the board, the whole point of my question is trying to AVOID that, because of monetary issues.
Anyways, I will probably go ahead and try this, and I will post back with my results eventually.

Well wtf, maybe if you would have stated that you don't plan on using the same model, I wouldn't have repeated myself.
But anyhow, like the others are saying, right now no one (other than MS) can give you a definate yes or no about detecting modded firmware. It has been quite awhile since the last round of bannings, so one may venture to say that you would be safe. Although, the next major update is right around the corner. So if MS has found a way, we'll know soon enough.
I understand what you're saying about being cheap, but stop and think, if you are worried about getting banned, would you rather spend an extra $20 now for a drive, or $200 later for a console? I'm not trying to be a smart ass and I'm not ragging on you, so don't take it the wrong way.
Another thing, those Samsung drives are loud. Especially the ms25. And they are known for their boards to go bad. Be careful if you're buying one. And I wouldn't even touch it if it's used.
Have you concidered just replacing the laser? They are more than $20, but less than the drives on eBay?

I may hold off and just play some downloaded games XBLA for a while. I had not heard that the samsung drives were any different.
I didn't mention this earlier, but it's not the laser that is broken, that I know of
What happened is that the little circular magnet cracked and jammed the motor from spinning. I cleared out the broken pieces of the magnet but now there is only 1/2 of the magnet left. The disc spins now but it struggles and I don't think it is getting the speed it needs.
Anyways, I would LOVE to be able to replace just the motor, but that is a hard part to find. Any suggestions? I know it's off topic.

Ah, I see. I purchased a console off eBay a while back which wasn't reading discs. When I opened it, the magnet was stuck to the top of the metal drive cover. It had come unglued. I just glued it back in.
You may have a lot more options because of your problem. What drive is it?

So after my last post, I found a site that talked about the screws that hold the motor onto the plate. The suggestion was to loosen them up. So I did.
It will play DVD's now but when I put in a 360 game (retail) it says that I need to put the disc in an xbox 360 in order for it to work. I did get it to boot the disc once however.
I don't have the time right now to keep adjusting, but I will keep trying. Any suggestions would be welcome. I might be on the wrong path.

Oh, and just to clarify, the magnet that was broken on mine was not the one on top of the disc. It is the magnet IN the motor. It's what gets it to spin. The magnet that holds the disc in is fine
