Four Google employees could face charges in Italy for not stopping a video, which depicts a teenager with Down's Syndrome being bullied, from being posted on its Google Video service.

The video, which was posted in 2006, shows about three-minutes of the handicapped boy being harassed. Google removed the video within a day, but by that time the video had already received about 12,000 hits.

The four employees could face charges on failure to exercise control over personal data and defamation. Google believes the charges are unwarranted and that Europe's E-Commerce Directive protects them.

I doubt this would happen in America -- though I do wonder how closely the US govt pays attention to online content. In a shared universe like Google, the culpability rests with those who posted. So why isn't the Italian govt making a case out of the posters? Overall, this case does not make sense to me, as Google took the video down.
