what about swapping the hdd from a banned one to an unmodified one and vice versa? is it safe or could the new unmodified console then be banned for content on the old hdd?

I would think it's okay to swap HDDs because it's only the console that is banned not the Hard Drive. Although it would make a difference if it had modded content in it.

There ya go, have a modded console for campaign and whatnot. Then have a legit console for your multiplayer games. That's what I do with Call of Duty and Gears

Yes it's OK, and yes you can use the banned consoles hard drive on an non-banned console perfectly fine. The main thing that seems to give off the flags are the console that's hacked and the disk used not the hard drive. So no worries.
