What he is trying to say is at the moment if you have a modded console and you play backups on it then go online, with a proper game or not, there is a HUGE chance you will be banned. Read about, its been all over the web for the past few days.
Bottom line - Modded 360 = High chance of live ban when connected.

This is answered on the 625 post 25 page thread titled " Diatribes for Newbies" check it out lol
seriously best bet is to play online with legit games and offline with backups with ur ethernet cable disconnected for now till u feel u have the balls to play online with backups. thats what ima do ;)
but then again u can still get banned NO MATTER WHAT! this question has more variations of answers than, "Whats the meaning of life?"

That's incorrect. And I've noticed this has been posted over a couple threads, so we need to stop that. The 360 logs everything that you play REGARDLESS if you are connected to xbox live or not. Therefore, it's not any safer to just unplug it, because the game is still recorded with some info about it. That info is then sent to MS next time it does connect to live.

Its just a suggestion since my boys been doing it for more than 2 years and hasnt been banned from both banhammers yet.
hes doing something right as of now, but u also have a point.
