john, you officially are an idiot. You will NOT get banned because you have 1.4 on your xbox. I HAD 1.4 on my xbox when I updated to the NXE seeing that 1.5 came out way AFTER the NXE did.

to the OP,
you can update. Chances are you will be fine. But if you do get banned, it will be because of bad games, not because of a drive firmware. I would recommend updating to 1.5 though.
