I tried to play a divx file on my 360 and got this error message:

"A media update is required to play this content. To get the update, sign in to Xbox LIVE and play the content again. Status code: 51-C00DF236"

I have never signed in to LIVE, for fear that my 360 will get banned. That being said, what are the odds that my 360 will get banned if I briefly sign in to LIVE to get the update? Also, is there a workaround to enable divx/xvid support without having to connect to LIVE?

Whats the diff if you connect now or 2 yrs down the road there's not, if it's gonna get banned it will, same as if it's already rdy banned and your not connecting thinking you might have slipped by the banning.Just go ahead and connect I have been using the same Xbox sence 1.2 firmware plus had the NXE leaked dashboard a month early and I'm still on live running strong.If your that worried about it go to ebay and buy a RROD console for 30 dollars fix it and use it for your burnt games or whatever.

But Also to answer your question about getting the update without connecting I found this at a torrent site don't know how true it is but you can try.

"After updating to the fall update 08 via Xbox Live, in order to play DivX/XviD video files a new DivX addon is required to be install via Xbox Live.

Included in this archive is the DivX media addon. Useful for those without Internet or banned console.

Connect the 360 harddrive to the computer using one of the many 360 harddrive adapters out there (Team Xecuter's Connectivity Kit, Talismoon 360 MiniSpy SATA adapter, or XCM 360 SATA adapter)

Open Xplorer360 and select 'Open Harddrive/Memorycard' and put the file in the same hierarchical folder structure as the one included in the archive. Create necessary folders.

Close Xplorer360 and power down the computer, and reconnect the harddrive to the 360. Make sure the dashboard version is 6683 and try to open a DivX/XviD file. It should play nicely if it's supported (AVI container with DivX/XviD video and MP3/AC3 audio) and if the media addon is located in the proper folder."

And for the name of the torrent do a search in google for "XBOX360.FALL.UPDATE.2008.DIVX.ADDON-Discovered.torrent"

I don't have the necessary cables so that won't work.

But if my console is in fact banned, then I can't even download updates from LIVE? Or I am just not able to play games online?

You can't do either. But you can manully update your games also,I see on news groups all the time game updates.
I would take the chance in get the update cause if you get banned trying to get this update then you have already been flagged along time ago.

assuming that I am not flagged yet, could i get flagged just for trying to download an update? or would I first need to play a backup in LIVE?
