no one knows, the way of detecting modified firmware hasn't been figured out/released/leaked yet. so right now nobody knows.

it's 'less likely' to get caught, but then again we don't know the detection techniques, so nothing is 100% fool proof, your best off having 2 360s, 1 modded and not on live, and 1 unmodded and on live for playing legit titles only.
