Precations to avoid ban hammer?

Has anyone ever been or knows of someone being banned on xbox live even after taking the utmost safety precautions? when i say safety i mean never playing a game before the release date, only playing real copies of games online, etc. The only reason i am asking this is me and my brother split the cost, paid 150 each for our 60gb 360 and i don't play or care about live, but he does, he plays it everyday and i want to get my xbox flashed within the next few days. Found a place that will flash liteon for 40$. Hopefully none flame me. Thanks for the replies. Any advice also on how to avoid the ban hammer would be appreciated.

I have NEver been banned, and YES I am proud of it, I have a new 360 (arcade jasper) and my ORIGINAL 360(Launch(super awsome cooling custome mod), AND my Elite from 2007. Neither have been banned and yes I use all 3. I make sure i use stealth patch games only and I use a awsome website that verifies.
Why am I so lucky
1- I use giganews (I just prefer it)
2-I use newsbin (crack version) I just like it
3-I use nzbrus=They prov more info compared to newsbin, I like to read the NFO before I download and read other users coments on their experiance dwn loading or using the game.
4- I verify with atleast 2 stealth chekcs, muleter scthrom etc
5-Always check xboxscene, to learn of any new updates or something that might happen to the modding community, its always good to be in the know rather out and guessing.
6-Keep 360 up to date with ixtreme.
7. I always play games early,
and if people ask online I say "no speaka dah english".
8-Use verbatims at 4x speed, no more no less. I recomend 8x disc, but 2x I still burn at 4x.
9-Get used to reading ABGX, and see which versions online are reputible or BAD , its saved me alot of headaches, just the chart of games not the tool.
10-Finaly, not listhening to all the scare mongers, haters and morons who keep reminding me of thier ignorance on how everyones going to get baned, last I checked the last guy before them was more convincing to me telling me I would get banned for just opening my console, atleast that had more credibility, but amusingly so, IM still waiting for 2012, and I probubly still wont be banned.

Thank you my good man , I just like to be the voice of reason in life. Usually theres a 1 upper that stpes in and tells you or I we are worng or THEY, whom every they are knows more. Truth be it there is NO definete way, but Llike SEX u can add more protection for your 360, by burning right and firmware updates, etc. Just too bad theres no 360 rubbers or we can agree that it needs a new spermacide, cough cough, I mean thermal paste.
Point being, learn what u can from those in teh know, and rate on a scale from 1 to 10 on the fear mongers,
if it makes em better fire them.

And what will be the reason for you getting banned when it happens? Every xbox has its day coming, micrsoft knows everything about the custom firmware, they can read just like we can, and when its publicly posted everywhere, then it isn't hard for them to figure out what is being done to the firmware and figure a way to detect it. they don't just get individuals, they wait and hit a group of people. the people that got hit on the first go round never saw it coming, i suspect no one will see it coming until about a thousand people are banned in one day.

I had my X-Box 360 chipped ( by the same guy who did my X-Box , P.S.2) I got a samsung drive with krean firmware to read game and Xbox Backup Creator to make ISO. Then I check it with abgx360 to make sure everything is correct with disc and burn with ImgBurn. No problems on live. The only thing I was told was Do Not play on line till the game is out.
Great so far...

If you keep dealing with It might or What if all yoru life then basically you should just 2nd quess everything. I would rather deal with WHAT IS. Im not banned and so are others out there, they like me probubly play early too, play bunk games, and do all sorts of crazy stuff. Its these fear mongers that really irk me, and put them right there with the cry babys on "OMG the verbatims are expensive". Last I checked your dubbing a game that cost $60 and your doing it for $5 per say, yeah thats worth crying for I guess.

wheres my proof? look around you, there are tons of posts about being banned a few pages over. no one knows what causes it, but playing games early isn't the safest thing to do when you know that microsoft can monitor everything that goes on within your xbox.

that was in 08, look up the ban wave from 07. i have got a launch day ms28 that still isn't banned, but that doesn't mean that it wont ever get banned. for all you know you could turn your xbox on tomorrow and it be banned. but like i said, they wont go for just you, or me, or even a handful of us, they are going to go for large numbers, so next time someone posts that they got banned, i know you will get on and check to make sure you aren't banned, because you don't know for sure that you won't get hit by it.

Posts are not proof, they are just ones version of their predicament. Face it yes it could happen, but it is mostly cause of Bad copies (crc, stealth, corrupt file etc)

Playing a game early is NOT a reason, that's just ignorant to state that. The legality of playing a game before release date is not a justification for a banning.

lets say that 5 million copies of a game are sold to distributors around the nation to be sold to consumers. out of that 5 million, 100,000 get it early and play it 2 weeks prior to its release date. the distributors know that only 500 copies have been shipped to magazines, online reviewers and given to employees to enjoy before anyone else. when that many more people play the game, they realize that the game has been leaked, and is being played illegally by someone with a modded console. each xbox has memory on the motherboard that can store all the information needed to pinpoint when a game is played and how far before the game was out and whatnot. if they can tell all that, then they know who has a modded xbox and its only a matter of time before you and i both get caught. im not here to argue with you, im just saying that you thinking you can't be banned is a joke.

flash your friggen xbox 360's and enjoy them while it last but for sure remember this, the only way to totaly prevent a 360 from being banned from live is... buy a ps3 and sell your xbox.

What's with all the hostility?
Obviously people get banned. Obviously it's because they either play games early or are unlucky with the ones they download.
Just try to research the games you download, don't play them early, (It's free, just wait a while...jesus) and take the risk. It's not a "matter of time" it's a matter of risk and luck! The person who's been going for 4 years is proof. Maybe he'll never get banned. Who knows.

Mike, as others have commented here, the only ignorant person here is yourself. Sure my comment about people who download games hit a nerve with you since you do it also (which is stupid). Sir, just wait until the game is RELEASED and make a backup of it once you OWN it-that's all I'm saying.
