Ive been browsing all over the forums to try to find a definate answer of whether i should go online with downloaded backups or not. Some people say never and some say they do it. Is it okay to go no live when using these. What % chance do you think i have of getting banned?

whether or not you play backups online or offline, you will eventually get banned. this is because it is widely believed that the 360 stores all the information regarding what games were played, and once you sign into live with a retail game, or a burnt game, it sends that information to MS and will eventually lead to a banning. so i guess your chance of getting banned is 100%, but how long that will take is up in the air, just depends on what precautions you take, like dont play games before their street date, play properly patched games, dont play reviewer copies of games, etc etc.

When you say properly patched do you mean stealth patched?
Also do they ban your xbox form live or just your profile or both?

yes i mean stealth patched, and they ban the console, not your GT.

So if they banned my flashed console lets say i bought a new one that i didn't flash. Could i play retail games on my new console and backups on my old console using my same profile ( transferring back and fourth with memory card ) without worrying about getting they new console banned.

honestly, no clue, i had one last for about 2 years, i have a couple of room mates that are going on like 3.5 years or so. had another friend that modded his about 2 months before the last november ban waves and got banned.
