Copy games in the HD is safer than used the Disc in a Flashed xbox 360 Drive? or is the same risk to be banned?

I think its the same risk either way but i would copy to hd if your want your drives lifespan to be longer.

either way the disc has to be in the drive to play the game so the same info is sent regardless. it shouldnt make a difference

I may be wrong but...

I'm sure the way bans have happened in the past is by a log being made of errors from the disc being spun. I'm sure it's loads safer to run the game from the hd because it only spins the disc once before playing the game. Therefore your not going to have barely any log record of disc spin errors and therefore not enough info for microsoft to ban you. I may be wrong though.

I personally try to get hold of the originals (rent/borrow a copy), install them to the hard drive then boot it each time with the copy.

If your playing offline I wouldn't worry about it. I only use this method for running copies on-line.
