I have both a legit and heavily modded xbox with the latest xtreme firmware. If I take my hard-drive from my legit console (the one that has my xbox live profile on it), and move it to my modded console, is there any danger of my account being banned or just the specific hardware? Also, if the hardware does get banned will the hard drive be toast as well or just the main console? Thanks in advance for serious replies!

No danger. Hard drives never get banned, and accounts do not get banned for hardware modding. Only console gets banned nothing else

Sweet. Last question though, do I HAVE to upgrade to the 1.6 firmware if I had an old school Toshiba-Samsung (originally the ms25 firmware)? I thought all v1.4+ firmwares were safe against xbox live challenges.

well 1.4 will not play newer games which are wave 3 and is pretty much garunteed on all future releases. 1.51 was released to play those and now 1.6 will add better live security and also play all game types. so since you need to be able to play newer games i would go ahead and update to 1.6 so you can benefit from all new features.
so if you have 1.4 then yesupgrade to 1.6. if you have 1.51 you dont have to upgrade but it is recommended.
