DLC for a backup copy of game

For modded Xbox 360's and only a backup copy of a game, could you still buy the download content for it? Not necessarily to play online, but for single player games like GTA dlc. Is it safe so you won't get banned?

you can download all you want with it regarding DLC. but you run the same risks of downloading stuff as playing on live in general.

I play a back up copy of Fallout 3 all the time and I access all three DLC's so far with no problem.
