Will a bad burn increase a ban chance?

I created a backup copy of game that would not properly load. It just kept saying loading.

As confident as one can be - I'm sure its stealthed correctly. My question is - will this increase my chances of a ban?

Your drive might have been struggling to read the data through the dye of the disc. Try increasing the laser strength with a POT calibration.

As for chances of ban, nobody really knows how MS decides to ban people and what they can detect.
