I didn't really take it as harsh. Just saying I stood corrected. Those hangovers will do it every time.

MS is bullshit, I agree they shouldn't say if you repair your console it violates TOS for Live. BUT, when you are a global corporate giant, I guess you can do what you want. Kind of reminds me of good ol' Goldman Sachs.

Microsoft may take any legal action it deems appropriate against users who violate Microsoft's systems or network security ,this contract or any additional terms incorporated or referenced in this contract, and such users may also incur criminal or civil liability.

No one and I mean NO ONE knows for sure why or how Microsoft bans, because of modded systems. There are many reasons you can find, but no one really knows for sure.

There are so many ways to burn disc.
There are so many different firmwares.
No one really knows what the log your Xbox360 reports back to MS.
You could of been on the ban list since days one, and they have not got around to you yet.

I've had a modded system on Live for about 2 almost 3 years now. No ban for me. I still am using Xtreme 1.4 and play nearly daily. I play my backups online!

I do know this. My day will come when I am banned!

Alright already, I get the message. I have a habit of skimming TOS's and missing important parts. BUT I do know this, most people have probably never read them and searched the TOS to prove me wrong. Come on now, no one reads ALL the fine print, unless of course your just really bored.

So, this would apply to everyone who ran the August 11 update? I haven't updated my console yet because I would like to run homebrew on my 360. I have my XBOX1 for that. I want to update but at the same I reconsider the possibilities of running homebrew. Its a complicated but simple process. Upon running the JTAG hack I would never be able to log onto live nor be able to upgrade the NXE.

If this were to be true, a log is recorded of all the games we play, the amount of times a disc is loaded and ejected, the movies we see, music, pictures, and the amount of times the dvd drive has been disconnected. We are screwed no matter how we look at this this because there should also be a way of detecting the current firmware if a log is kept. I'm just assuming, I'm not saying is true.
