if i was to rent new wave 3 games and load them to my modded xbox would the " update " that comes on the original game would that let me play a copy of the the same game ???

Tested that myself (with HAWX), the answer is no. Not untill you have atleast iXtreme 1.51.

PS3: Untouched 160 GB Slim, 60 GB Fat with latest Rogero and 160 GB internal harddrive.
PSVita: hardly ever play it
GameCube: Black with a Viper chip installed. With gameboy player. Trying to get a Wavebird controller.

No. The update that comes on the game disc is an Xbox 360 system update, not an iXtreme firmware update. These are two entirely different things.
