With the article of the 27 year old getting busted, I am simply confused. Are we apparently not allowed to have backups of games we own? Is everyone here dropping their services? I always understand it wasn't the flashing that was illegal but selling pirated games. I was going to post some ads on craigslist, but heard people are getting busted on there. Any thoughts? If it were so illegal why don't they shut down the sites? How is afterdawn allowed to post topics and guides on how to do these mods if they are illegal? This simply makes no sense.

modding you box it boderline legal. the reason that guy got bustend was he "modded boxes" for a profit. if he did it for free there wouldn't have been a problem. that is the simple version.

That's the problem. Who wants to flash for people now that people are getting busted. I've heard craigslist is one to stay away from.

its not worth it period, you seen what kinda jail time and fines these guys are getting? it would be one hell of a crushing blow to your life to have to go throught that. just my 2 cents.

It's illegal as you are changing MS's software to be used in a way that's not intended. This isn't a grey area like making a back up of a cd that you own, this is pure 100% illegal.

so making a backup of your game is different than making a backup of a CD. The rights are the same.

like homesick said, it's the firmware flashing for profit that got the person busted.
because ixtreme/xtreme firmware allows you to run games that are not on original pressed discs, it makes modding, in general, borderline legal. for personal use, it's supposedly fine, but if you do it for profit, it's illegal.

Yes, the PEOPLE who change Microsofts code, that is illegal. They are modifying Microsoft code without their permission. Again, I'm sure playing backed up games is frowned upon, but you DEFINITELY cross the line when you charge money to do such modifications.

Circumventing copy protection by any means is a crime in the USA as of 1998 when the DMCA was passed.
Whether your create that firmware or just use it, it is a crime. This has nothing to do with charging money for the service or not charging money. There is no grey area.
The situation with CDs and tapes is different because there is no copy protection on CDs and tapes.
That being said, there are TONS of people out there who violate the DMCA every day. A few of them get popped every year. Just don't be stupid and you'll be okay.
