Do they detect the hack or the backup game? If my drive is flashed but I never play on live with a backup game will I get banned?

I remember way back when my ms-28 was flashed and the wave of bans started to hit I never go banned because I didn't play backups on live. Is this still the case?

If you never everrrr everrrr eveerrrrr everrrrrrrr play on live you wont get banned. But you can never everrrr everrrrr eeeeverrrrr play on live.
