Why do you need to mod your xbox to play burnt games?

I know it's a pretty dumb question, I've already modded my xbox and everything but now I'm wondering. Why do you need to mod your xbox to play burnt games? Instead of focusing on modding xbox's, why don't people figure out how to make legit games (in the xbox's eyes)

You can't replicate a pressed disc at home. So you must have firmware that looks for the security info at different locations on the disc.

the technical reason is some files that are written on 360 games are in a location a normal burner can't burn to. This file is copied in a different location on a backup game.

The firmware then reads it from this second area if it isn't present in the original, which then verified that the game is legit.

If it didn't have the hacked firmware, the dvd drive wouldn't know to look in the second area, and then the game couldn't play.
