Judge overturns $388 million patent award in Microsoft case

article published on 1 October, 2009

A federal judge has overturned a court judgment against Microsoft in a patent dispute that would have cost the company $388 million. The federal judge ruled on Tuesday that Microsoft did not infringe on a patent held by anti-piracy software maker Uniloc Inc. U.S. District Judge William Smith's decision nullifies the $388 million Microsoft would have had to pay in damages. It would have ... [ read the full article ]

Finally some justice for Microsoft. Funny that a Chinese firm would accuse Microsoft of stealing their intellectual property when the Chinese are the world's leading pirates themselves and not just software piracy either. Everyone likes to take potshots at Microsoft or sue them for money they could not earn on their own merits, but let's face it, Microsoft has enough brilliant minds working for it to never need to steal ideas from anyone. Bravo to the judge and to Microsoft for not letting this one go.

Justice? HAH! They will now probably use this judgement to help them "beat the rap" in the "WORD" and I think email, copyright/patent trials that are currnetly underway.

I don't think it's right for a Jury verdict to be overturned by one judge, who is accountable to no one. If a jury verdict is appealed, it should be taken before a new jury. The odds of getting a person in to the deliberation go up, with a jury, as opposed to judges who went to college 100 years ago, and don't even know what ram, HD and dual core mean, let alone how anti-piracy and software security systems are configured, or how they link throught a computer system.

This is hardly justice. The security software was not Microsoft's property, and they pirated it. They did so in such a way that an American court ruled in favor of a Chinese company against this American company. Of course, the higher courts are more corrupt than the lower ones...and Microsoft took advantage of that. Fittingly, they used the software code that they pirated in order to harass their own customers under the pretenses of preventing piracy! This did not prevent piracy, but it has caused a lot of trouble for their paying customers. The fact that Microsoft keeps beating these giant lawsuits in the high courts is sickening.

The patent office was set up for a very specific reason. This was to make the development of new concepts a potentially profitable venture. This leads to the advancement of technology as well as the culture it influences. By repeatedly letting Microsoft off the hook, the courts have sent a very specific message to inventors as well as concept developers: Don't try, you will end up spending a fortune on development and patent costs...then you will spend a few more fortunes on lawyers...then they will have your case thrown out by a corrupt judge that wasn't even elected! So why bother...you might as well just max out all your credit cards with cash advances, then burn the cash...it will save you a few fortunes and 10 years of your life!

BTW...I'm not a Linux fan boy, I frequently trash Apple and Sony, and I like windows 7 a lot...but what Microsoft is doing to this country is worse than vista!

Ha ha ha ha ha ha ha!!!!!!!!!!!! Microsoft have never stole anything ha ha ha ha ha ha ha ha ha I do believe you are totally misinformed. The pirates of silicone valley have alot to answer for, regarding theft. As for brilliant minds producing the worlds most bloatware OS and officially the least secure, virus/malware ridden vulnerable major OS in the world, so lets take our hats off to microshaft's brilliant minds, we salute you with 2 fingers at you!!!

Here's the deal. Big companies like Microsoft will never go to trial unless they think they're right. These companies will always settle out of court if they are wrong. It's been like this for the last 20 years. The first decision that ruled against Microsoft was a Jury's emotional decision which was fairly easy for the Plaintif to get with all the animosity going around. Just look at the posts here.

Oh please STOP your whining attacks on Microsoft. I dont hear one of you complaining when these "too stupid to work at a real job" rap artists "sample" songs or riffs that clearly DO NOT belong to them for their music..and then dont pay the original artist a damn dime. Take "Puffy" Combs who STOLE the whole music line from the Police Song "Every Breath You Take" and used it in a faux tribute to another rapper and then refused to pay the Police their due! Or Kid Rock who stole the riff of "Sweet Home Alabama" from Lynyrd Skynyrd and then did not pay the Skynyrd band a dime of the millions he made from that song. I dont hear ONE of you saying a damn thing about all the bootleg stuff in China or how China has stolen stuff from many different nations and then mass produced it. Holy Christ I can go down just about ANY street in Hong Kong and get a rolex that looks so real it is not funny and only a jeweler would be able to tell the difference, for less then 100. or any brand new movie still in the freaking theaters for $5. Or let us not forget the Chinese Scientist here on a temporary work visa that was caught at the LAX airport with copies of top secret nuclear blueprints for enriching uranium that he stole as he was heading home to China. And you people have the AUDACITY to try and chastise Microsoft for doing to China what the Chinese have been doing to the world for the last 60+ years? Pull your heads out of your arses and join the rest of us in the freakin real world for once.

It's amazing to me how the people with the least actual knowledge seem to have the most negative things to say. Witness Mike(USA) who resents judges who have gone to school 100 years ago making decisions today. In fact the judge on the Microsoft $388 million lawsuit got his degree in 1982 and his JD in 1987, hardly 100 years ago and definitely recent enough to be up on the latest.
As far as the Word lawsuit goes and "i think, the email" lawsuit, look up the facts man. It's not so much Word but XML that is the issue in the Word lawsuit and as far as the email lawsuit goes, if it's the Visto lawsuit, that one was settled years ago. Just do the research before you post as your uninformed comments could influence others wrongly. Here is the patent in question; The patent by i4i offers a "Method and System for Manipulating the Architecture and the Content of a Document Separately from Each Other." That's fairly vague, but it generally pertains to the editing of content in a document that's been marked up with XML. Microsoft has a patent that's more specific, in that it offers a way for computing devices to grab data from a marked up XML document without the need for word processing software. So you see, the i4i patent should never have been issued in the first place as it really is too broad and non-specific.

@ raunchynm, hotdotdog and Daniel_1 . I think you folks should investigate the history of microshaft before you go defending them. We can all use the copy and paste function on our keyboards, so I will not post the history for you here. But suffice to say the company was nearly broke up into small pieces for it's behaviour in the past. Do some research before you make another comment please.

Gotta love the people that are smarter than everyone else. (Raunchynm) I suspect, since my "outlook" uses "Word" for incoming and outgoing doc's, the lawsuit has effects on email stuff too. The nissues relating to microsoft have so many tentacles, it's not erroneous or "stupid" or "uneducated" to make the links.

as far as judges go, most of them are lawyers, but contnually step out of their expertise (law) in regards to tech issues (technology law).

Some legistlate things into existence from the bench (bypassing the REAL legislature) or rubberstamp things passed by the house and senate (REAL legislature) ie: DMCA, regardless or the rediculous results ie: Granmas being sued who don't even know how to use a computer, or people being bancrupted for fielsharing.

I'm an enduser, who buys legit copies of Windows OS for 15 years, MS-OFFICE, DJ Software etc.

I buy tons of music LEGALLY.

There is a nasty web of strangulation that Microsoft and various gov't entities are creating, A world where Girls Scouts can be sued into oblivion for singing Kumbya without a license, while the Bill Gates Team appropriates newtech and the means to protect their licensed products )without compensating the originators of the method to protect their OS and software. . The LECENSE PROTECTION WEB is getting tighter and tighter, but it's only protecting Gov't, record/movie companies and the Microshafts of the world.

Microsoft assisted or abetted by the legal system devours or stomps out competitors.

So that's my issue. I'm all for protecting licensing for products, and the creating of mechanism to ensure the integrity of licensing, but not just for the big boys but also the little guys who are being scammed out of their just do's by the likes of microshaft.

To all of the Microsoft haters. Its pretty damn clear here why Microsoft is so powerful. People pay for their products. So they must have done something right otherwise they wouldn't be around for you guys to rip on. I am just the average consumer and I am simply stating the facts that Microsoft is around because they keep making things people buy. Now I understand that they do make a bad product every now and then or are a little shady at times but its not the entire company to blame. I mean what company doesn't have its mishaps.
I love Apple, Sony, Linux, Nintendo etc. Their competition keeps prices down for Microsoft and vice-versa. So please don't play favorites and just buy the products that interest you the most. That is what I do and that is how a capitalist system works.

people are stupid. How can you feel so strongly one way or the other knowing nothing about the case? Obviously you people have no clue about anything, especially since a lot of arguments are about the Chinese, and this company is based out of Singapore. Given there are many Chinese who live in Singapore but it is not a Chinese nation. Also, a degree in 1987 or 83 or whatever you wrote, is not very recent. Actually it might as well have been 200 years ago as far as the computer tech industry is concerned.

@xnmalletx What do you mean by they must be doing something right!!! Did you not read up on why the company was going to be split up into piece's? Obviously not eh!! The tactics that MS used to make sure pc manufacturers used an MS OS nearly broke the company up. Its a pity that they were not broken up, but hey they must be doing something right eh? (sarcasm is for free on this statement).
Why do people not get it microshaft are corporate bullies liars and thieve's, but yet the casual user is not tech savvy and just gets his/her pc shipped with an MS OS and thinks what are all you MS haters banging on about?
Oh jeez I give up on the hopeless.

LET'S TALK ABOUT FIRST BLOOD:

when Steve Jobs was taking two years to make Mac, the code was poured over by hundreds of programmers including one New software upstart, first name William, hired as a Consultant.... this consultant got his name in the industry by buying a file system frim it's maker for $5000 and then licensing it for millions. (only code he wrote was what was needed to claim the software as his own)

When William was done consulting, Steve Jobs was still months from release so Billy Boy did tie natural thing.... he "wrote" WINDOWS for the PC...

Yes, "William", is Bill Gates himself, the file system was called MS-DOS, and what we know as WINDOWS is a direct result of his having seen the code for MAC a year, - year and a half, earlier

I don't know why Jobs didn't sue at the time Gates was most vulnerable(or didn't win if he did sue), but it is obvious that Bill Gates didn't have an original thought throughout his entire (business) life... instead his strategy is to rush to market with a buggy program and "fix" it (or more accurately "affix his customers to his company") with the incessant updates that usually add more bugs

I recently converted to Linux (Suse 11.1) and it is not perfect by no means, but the cost is free meanwhile there are people out there that are stumping for M$ and making web pages that do not work with anything but windows. there were a couple of pages that required me to install Dot NET 2.0 while I was still a M$ box.... I quickly uninstalled it when I noticed the drastic slowdown in Firefox.... the uninstall and a reboot had Firefox going as fast as before NET 2.0

I have a lot of empirical evidence that M$ should be written as "Microshit" and the history of the company and it's founder shows his/it's propensity to "borrow" from the competition

how about this: one site requires a microsoft operating system to use the WYSIWYG editor for it's site... but when IE7 gave "us" tabbed browsing the WYSIWYG editor didn't work for IE7....

now tabbed browsing has been in Firefox for years so I was appalled at the people that loved the "new" feature that MS given them but when I investigated thy the editor wouldn't offer WYSIWYG mode I saw where Microsoft got the Tabbed browsing code: using Javascript, I got the browser to tell me what version of IE it was... instead of "IE7" it said "Mozilla Firefox"

my true stories about Microsoft are like Ralf Malf's bad jokes ... "I gotta million of 'em"

I think you will find that most of the internet itself is run on *nix. Why? because proprietary software is limited. You think windows has the biggest support? In what way do you mean? People who run windows on their pc support, or business's who run windows support?( yeah like many business upgraded to vista, not and few will upgrade to 7 either me thinks) or are you meaning software support, as in dear slick willy How do I get this to work support? Yeah theres not much support for linux users PMSL. If you were a free thinker then think out of the box, dont confine yourself to what other people tell you to do with their software. Remember this, you dont own a copy of any microshaft product, you own a licence to use it. Big difference. Anyway my fellow AD member, maybe 1 day you will realise what I am saying and truely become a free thinker.
Good luck.
